Information Text on the Protection and Processing of Personal Data in Relation to e-Government Gateway Users

In this Disclosure Text, and within the framework of the duty of operating the e-Government Gateway, our aim is to give you information about your personal data processed by our Company, TÜRKSAT UYDU HABERLEŞME KABLO TV VE İŞLETME A.Ş. (“TÜRKSAT A.Ş.” or the “Company”) pursuant to Article 10 titled “Disclosure Obligation of the Data Controller” of Law no. 6698 on the Protection of Personal Data (“LPPD” or the “Law”) published in the Official Gazette dated April 7, 2016, under issue no: 29677, which aims to protect the fundamental rights and freedoms of individuals, especially the right to privacy, in the processing of personal data, and the “Communiqué on the Procedures and Principles to be Observed in Fulfilling the Disclosure Obligation” published in the Official Gazette dated March 10, 2018, under issue no: 30356.

DATA CONTROLLER

As per Article 527, paragraph 1, item (a) of Presidential Decree no. 1 of 10.07.2018, and Article 14 on Law no. 5523 on Certain Arrangements Regarding Offices under the Presidency of 21.06.2006, the duty to establish and manage the e-Government Gateway is performed by the Presidency of the Republic of Türkiye, Office of Digital Transformation. The operation of the e-Government Gateway is carried out by Türksat A.Ş. on behalf of the Presidency of the Republic of Türkiye, Office of Digital Transformation.

In this framework, TÜRKSAT A.Ş. bears the title of “Data Processor” on behalf of the Data Controller, the Presidency of the Republic of Türkiye, Office of Digital Transformation, as per Law no. 6698 on the Protection of Personal Data (KVKK), and you may contact us using the following contact information.

PERSONAL DATA PROCESSED

Your personal data below is processed within the scope of your relationship with the e-Government Gateway:

  • Your Identity Information: Identification number, name and surname, place of birth, date of birth, gender, marital status;
  • Your Contact Information: Email address, mobile phone, Address Registration System record;
  • Your User Transactions Information: Requests / complaints / suggestions;
  • Your e-Government Gateway Login Data: The mode of logging on to the e-Government Gateway (password, e-signature, mobile signature, internet banking and Republic of Türkiye identification card) and data on the bank from which login has been performed, (information on which company transactions have been performed (in the use of legal entity services);
  • Data Relating to Control and Inspections: Data relating to cyber-security within the scope of data that may be subject to control and inspection, voice recordings, IP and port information;

PURPOSE OF PROCESSING OF PERSONAL DATA

Your personal data collected may be processed within this scope of your relation with the e-Government Gateway for the following purposes.

  • Full and proper fulfillment of our contractual and legal obligations,
  • Carrying out the necessary procedures for requests of users received via the systems,
  • Execution of online and mobile operations,
  • Initiating the process for the identification / changing of the e-Government Gateway password, and the related process,
  • Keeping the e-Government Gateway logs,
  • Providing the e-Government Gateway Communication Center (EDKİM) service and fulfilling contractual requirements,
  • e-Devlet Kapısı Çağrı merkezinden alınan talep ve şikayetlere ilişkin süreçlerin yönetilmesi
  • Keeping and following up log records required to be kept within the scope of the regulatory and security analysis of the e-Government Gateway system,
  • Ensuring the security of the e-Government Gateway web server,
  • Obtaining and updating contact information on the e-Government Gateway profile page, using such contact information in notices made / to be made by the e-Government Gateway,
  • Executing online e-Government and e-Signature letters of undertakings,
  • Performing the instant notification key process specific to mobile devices,
  • Logging on to the e-Government Gateway via internet banking,
  • Performing the digitalization of e-Government Gateway password delivery documents,
  • Detecting and repairing breakdowns,
  • Development and diversification of our services,
  • Performing our quality and standard audits,
  • Meeting information requests from judiciary and administrative authorities.

İŞLENEN KİŞİSEL VERİLERİN AKTARIMI

Within the scope of the provisions of the Law relating to the transfer and foreign transmission of personal data, your personal data may be shared with domestic public and official institutions and agencies authorized by law, law enforcement agencies, courts and execution offices, domestic and third-party real and legal entities, service providers and their officers, business partners, banks, suppliers, and support services providers, and foreign representation offices of the Republic of Türkiye for the purposes stated in this Information Text.

METHODS AND LEGAL GROUNDS FOR COLLECTING PERSONAL DATA

Türksat A.Ş. collects your personal data when you contact the e-Government Gateway and/or during the establishment of our legal relation and throughout the duration of such relation for the purposes of achieving the aforesaid purposes and providing the services within the framework stipulated in Articles 5, 6 and 8 of the Law, from you and third parties and legal authorities, including our business partners, group companies, affiliates, solution providers we work with or have a contractual relation with, and through call centers, Internet, mobile application, social media and other public media or training, events or similar activities.

RIGHTS OF THE DATA SUBJECT WHOSE PERSONAL DATA IS PROCESSED

You have the following rights in relation to your personal data in accordance with the provisions of Article 11 of the Law

  • To learn whether or not your personal data is being processed,
  • To request information on the procedure, if your personal data have been processed,
  • To ascertain the purpose of the processing of personal data, and whether such data are being used for the intended purpose,
  • To ascertain the identity of the third parties to whom data are being transmitted at home or abroad,
  • Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme
  • To request that the personal data be deleted or destroyed,
  • In case of correction, deletion or destruction of personal data, to request that such operations be notified to third parties to whom such personal data has been transferred,
  • To object to the occurrence of a result which is detrimental to the data subject as a result of analyzing the processed personal data exclusively through automated systems,
  • Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme.

IF YOU WOULD LIKE TO CONTACT US FOR YOUR RIGHTS AND REQUESTS

You may communicate your requests within the scope of the above-specified rights by using the registered electronic mail (KEP) address, over the address turksatuydu@hs01.kep.tr by using your electronic mail address that had been previously notified to our Company and which is registered with our systems, by visiting the address www.turkiye.gov.tr for the “Application Form on Personal Data”.

Personal applications to be made in this scope shall be admitted following the verification of identity, and your requests shall be concluded as soon as possible, and no later than within 30 days, depending on their nature. In the event that the application requires a written response, no fee shall be requested for up to 10 pages, but a transaction fee specified under Article 7 of the Communique on the Procedures and Principles for Applying to the Data Controller may be charged for each page after 10 pages. A fee corresponding to the cost of the recording medium may be charged in the event that the response to the application has been provided in a recording medium such as a CD or flash disk.
